Johnson’s baby powder, a product seen in almost every home and used on almost every infant was sued by a woman due to the belief that the powder caused her ovarian cancer. You will be shocked that this particular woman’s case is actually one out of a thousand similar complaints.
Los Angeles Superior Court jury released a verdict in favor of the woman, Eva Echeverria. They ordered Johnson’s baby powder manufacturer to pay $417 million in damages. Eva claims that after years of using Johnson’s products that were specifically for feminine hygiene, she developed ovarian cancer.
Eva’s case was one of the biggest lawsuits that J&J has faced in relation to the risks of their products. A strong argument is that the company has failed to effectively warn their consumers about the cancer risks of talc-based products. Eva’s lawyer, Mark Robinson, was pleased with the outcome of the trial.
“We are grateful for the jury’s verdict on this matter and that Eva Echeverria was able to have her day in court,” he says.
The $417 million was a combination of $70 million in “compensatory damages” and the other $347 million in “punitive damages.” Obviously, a big blow to the mega company because 4,800 similar cases nationwide are on its tail. Johnson’s is also hit with $300 million in verdicts by different juries from the state of Missouri.
Eva’s case was said to be the first out of hundreds of talc cases that had a trial in California. ABS-CBN writes about Eva’s situation:
“The 63-year-old claimed she developed terminal ovarian cancer after decades of using J&J’s products. Her lawyers argued J&J encouraged women to use its products despite knowing of studies linking ovarian cancer to genital talc use.”
But Johnson’s is hitting back by saying that studies and other federal agencies did not find any proof that talc products cause cancer. Eva’s trial against them was the sixth so far and J&J has already lost four of those. But the company still files for appeal because they believe that their products are safe and are backed by science.
